Welcome to konspekt.ai ("Platform"). These Terms of Service ("Terms") form a legally binding agreement between you (whether personally or on behalf of an organisation, "you", "User") and Individual Entrepreneur Kovalchuk Dmytro Oleksiyovych, registered in Ukraine (RNOKPP 3582801257) ("Company", "we", "us", "our"), governing your access to and use of the Platform and all related services, channels, and applications.
1. Acceptance of Terms
By registering for, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Refund Policy, and Acceptable Use Policy, which are incorporated herein by reference. If you do not agree, you must not use the Platform.
2. Description of the Service
Konspekt AI is an AI-assisted learning management platform that allows educators and tutors to upload source materials ("Knowledge Base"), generate lessons, lectures, tests, and homework using artificial intelligence, organise them into courses, and share them with students who join via a class code or email invitation. The Platform tracks student progress, answers, and grades.
3. Eligibility and Age Restrictions
You must be at least 16 years old to create an account independently, or such lower age permitted under your local law (but never below 13). The Platform is intended for educators, tutors, and learners.
EU/EEA users (GDPR Art. 8): if you are below the age of digital consent in your member state (13–16 depending on the country), you may use the Platform only with the consent of a parent or guardian.
Children under 13 (COPPA): we do not knowingly collect personal data from children under 13. If you are an educator inviting students under 13 via a class code, you represent and warrant that (a) you act as an authorised agent of a school or educational institution, and (b) your institution has obtained any verifiable parental consent required under COPPA, FERPA, or equivalent local regulations. By creating an account you confirm that you meet the minimum age requirement above; where necessary we may ask you to confirm your date of birth to verify your age. If we learn that we hold data of a child under 13 without the required basis, we will delete it.
4. Accounts and Security
You agree to provide accurate, current, and complete registration information (including via "Sign in with Google"). You are responsible for safeguarding your credentials and for all activity under your account, and must notify us immediately at support@konspekt.ai of any unauthorised use.
5. Acceptable Use
Your use of the Platform is governed by our Acceptable Use Policy. In summary, you must not use the AI tools to create unlawful, harmful, or infringing content, attempt to bypass credit limits or payment systems, scrape or reverse-engineer the Platform, or upload malicious code.
6. Subscriptions, Credits, and Payments
Certain features are provided on a paid basis through subscription plans. AI generation consumes "credits" from your balance. Prices, plan limits, and credit allowances are displayed before purchase and may vary by plan.
Payments are processed by our third-party payment provider WayForPay. We do not store full card numbers; we retain only a masked card reference and, for recurring plans, a tokenised payment identifier supplied by the provider. By subscribing, you authorise us (via WayForPay) to charge the applicable fees.
Auto-renewal: subscriptions renew automatically at the end of each billing cycle (monthly or annually) at the then-current price, unless you cancel before the renewal date via your account settings. You may cancel at any time and will retain access until the end of the paid period.
7. Refunds
Refunds are governed by our Refund Policy, including the 14-day right of withdrawal for EU/EEA consumers and the waiver that applies once AI generation has been performed.
8. User Content and Intellectual Property
Your content: you retain all ownership of the materials you upload (the Knowledge Base) and of the lessons generated from them. You grant us a limited, non-exclusive, worldwide licence to host, process, and transmit this content to our sub-processors strictly to provide the Platform to you. This licence ends when you delete the content or your account.
Your warranties: you represent that you have the legal right to upload and process any third-party materials in your Knowledge Base.
Our property: the Platform software, design, models orchestration, logos, and UI/UX are the exclusive property of the Company or its licensors.
Copyright complaints: if you believe content on the Platform infringes your rights, contact support@konspekt.ai.
9. AI-Generated Content Disclaimer
The Platform uses artificial intelligence. AI systems can produce inaccurate, incomplete, biased, or fabricated output ("hallucinations"). All AI-generated content is provided "as is". You are solely responsible for reviewing, verifying, and editing all generated materials before using them with students or for any other purpose.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or reputation, arising from your use of the Platform or any errors in AI-generated content. Our total aggregate liability shall not exceed the amount you paid us in the six (6) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or any mandatory consumer rights.
11. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, losses, and reasonable legal fees arising out of your violation of these Terms or your User Content infringing third-party rights.
12. Suspension and Termination
We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy. You may stop using the Platform at any time. To have your account and associated data deleted, contact us at support@konspekt.ai; we will process your request as described in our Privacy Policy.
13. Changes to These Terms
We may modify these Terms. For material changes we will notify you by email and/or a prominent in-Platform notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. EU/EEA users who disagree with material changes may terminate their subscription without penalty within the notice period.
14. Governing Law and Disputes
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules, and disputes shall be brought in the competent courts of Ukraine.
EU/EEA consumers: nothing in this clause deprives you of the protection of mandatory provisions of the law of your country of habitual residence, including the right to bring proceedings in your local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform.
